Applicable Legal Framework<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Due to the geographical diversity of users, NOVALLIANCE LIMITED applies a combined legal framework in order to ensure consistent protection of personal data.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>European Union: data is processed in accordance with the principles of transparency, lawfulness, purpose limitation, minimisation, security, and respect for the rights of data subjects, as defined by the General Data Protection Regulation (GDPR).<\/li>\n\n\n\n<li>United Kingdom: data is processed according to principles equivalent to those applicable within the European Union, in accordance with the United Kingdom General Data Protection Regulation (UK GDPR).<\/li>\n\n\n\n<li>United States: data is processed in compliance with the rules applicable to consumer protection, fairness of practices, and data security, in particular under the Federal Trade Commission Act (Section 5) and applicable state-level regulations.<\/li>\n\n\n\n<li>Canada: data is processed in accordance with the principles of consent, transparency, and security provided for by the Personal Information Protection and Electronic Documents Act (PIPEDA).<\/li>\n\n\n\n<li>Switzerland: data is processed in compliance with the obligations of transparency, proportionality, and security provided for by the Federal Act on Data Protection (revFADP).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It is the Client&#8217;s responsibility to ensure that their use of the Service, in particular regarding prospecting, electronic communication, and the exploitation of data from third-party platforms, complies with the laws and regulations applicable in the jurisdiction in which they conduct their activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This Policy does not have the effect of relieving the Client of their own legal and regulatory obligations, in particular regarding the protection of personal data and commercial prospecting.<\/p>\n\n\n\n<h2 id=\"h-2-roles-and-responsibilities-in-data-processing\" class=\"wp-block-heading\">2. Roles and Responsibilities in Data Processing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When a Client uses the NOVALYA platform to access data from third-party platforms, automate prospecting actions, generate content, or exploit data within the framework of their activity, they act as a Controller within the meaning of the General Data Protection Regulation (GDPR), the UK GDPR, and equivalent legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this respect, the Client alone determines the purposes and means of the processing of personal data that they implement through the Service, and remains solely responsible for compliance with applicable legal obligations, in particular regarding the legal basis, the information of data subjects, and the compliance of the processing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Within the framework of the use of the Service, and in particular for operations of access, exploitation, automation, or technical processing of data, NOVALLIANCE LIMITED acts exclusively as a Processor, within the limits of the operations strictly necessary for the provision of the Service and on the Client&#8217;s instructions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For data relating to the management of Client accounts (in particular identification data, login information, billing and subscription data), NOVALLIANCE LIMITED acts as a Controller, for its own needs related to the management of the contractual relationship and the operation of the Service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NOVALLIANCE LIMITED may use sub-processors, in particular for hosting, security, technical processing, sending emails, or payment management.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this context, NOVALLIANCE LIMITED undertakes to select service providers offering sufficient guarantees regarding data protection and to govern such processing through appropriate contractual obligations, including when data is processed outside the European Union.<\/p>\n\n\n\n<h2 id=\"h-3-personal-data-collected\" class=\"wp-block-heading\">3. Personal Data Collected<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Within the framework of the use of the NOVALYA platform, personal data is collected and processed according to the capacity in which NOVALLIANCE LIMITED intervenes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>as Controller for data relating to Clients using the platform;<\/li>\n\n\n\n<li>as Processor for data exploited by the Client within the framework of the use of the Service, in particular data from third-party platforms or processed within the framework of prospecting actions.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-3-1-data-collected-by-novalliance-limited-as-controller\" class=\"wp-block-heading\">3.1 Data Collected by NOVALLIANCE LIMITED as Controller<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Within the framework of the creation, management, and use of a Client account, NOVALLIANCE LIMITED may collect the following data:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Surname and first name;<\/li>\n\n\n\n<li>Email address;<\/li>\n\n\n\n<li>Billing postal address;<\/li>\n\n\n\n<li>Telephone number, where applicable;<\/li>\n\n\n\n<li>Payment-related information (including transaction details, amount, date, payment identifier). Banking data is processed securely by specialised providers and is not directly accessible by NOVALLIANCE LIMITED;<\/li>\n\n\n\n<li>Technical data related to the use of the Service (IP address, connection logs, device type, browser used, timestamps).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The personal data collected is processed solely for the purposes necessary for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The creation and management of Client accounts;<\/li>\n\n\n\n<li>Secure access to the platform and its features;<\/li>\n\n\n\n<li>Management of subscriptions, billing, and payments;<\/li>\n\n\n\n<li>Customer assistance and support;<\/li>\n\n\n\n<li>Security, stability, and improvement of the Service;<\/li>\n\n\n\n<li>Prevention of fraudulent or non-compliant use.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These processing operations are strictly limited to what is necessary for the performance of the contract and the operation of the Service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, when a Prospect accesses a free trial period or enters into a relationship with NOVALLIANCE LIMITED, certain identification and contact data may be collected. This data is used exclusively to allow access to the Service, the management of the relationship with the Prospect, and the sending of communications related to NOVALLIANCE LIMITED&#8217;s activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Prospect may unsubscribe at any time from the communications sent to them.<\/p>\n\n\n\n<h3 id=\"h-3-2-data-processed-by-novalliance-limited-as-processor\" class=\"wp-block-heading\">3.2 Data Processed by NOVALLIANCE LIMITED as Processor<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Within the framework of the use of the Service, NOVALLIANCE LIMITED processes, on behalf of the Client and on their instructions, personal data in particular from third-party platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This data may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Accessible identification data (surname, first name, pseudonym, profile picture);<\/li>\n\n\n\n<li>Contact data made accessible (including profiles or public identifiers);<\/li>\n\n\n\n<li>Public content or interactions (comments, publications, reactions);<\/li>\n\n\n\n<li>Data relating to interactions generated via the Service (messages sent, responses, exchange history);<\/li>\n\n\n\n<li>Data relating to automated actions (timestamps, frequency, campaign parameters);<\/li>\n\n\n\n<li>Technical data associated with the use of the Service.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This data is processed exclusively in order to allow:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The execution of the features of the Service;<\/li>\n\n\n\n<li>The automation of prospecting and engagement actions;<\/li>\n\n\n\n<li>The management and monitoring of interactions;<\/li>\n\n\n\n<li>The exploitation of campaigns configured by the Client.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">NOVALLIANCE LIMITED only exploits this data to the extent strictly necessary for the provision of the Service and does not determine the purposes or methods of use thereof.<\/p>\n\n\n\n<h3 id=\"h-3-3-data-from-integrations-and-third-party-services\" class=\"wp-block-heading\">3.3 Data from Integrations and Third-Party Services<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Within the framework of the use of the Service, the Client may connect third-party accounts or services, in particular social networks, CRM tools, emailing solutions, or other external services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data transmitted, synchronised, or exploited through these third-party services is done at the initiative and under the exclusive responsibility of the Client.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NOVALLIANCE LIMITED acts only as a technical service provider allowing the interconnection of these services, without determining the purposes or means of the processing carried out through these tools.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is the Client&#8217;s responsibility to ensure that the use of these third-party services complies with the regulations applicable to the protection of personal data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NOVALLIANCE LIMITED&#8217;s liability cannot be engaged in respect of the processing carried out by these third-party services or the conditions under which the data is processed therein.<\/p>\n\n\n\n<h2 id=\"h-4-disclosure-of-personal-data\" class=\"wp-block-heading\">4. Disclosure of Personal Data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data collected and processed through the NOVALYA platform is intended exclusively for NOVALLIANCE LIMITED, acting as the case may be as Controller or Processor, in accordance with the provisions of this Policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NOVALLIANCE LIMITED undertakes never to assign, rent, or sell personal data to third parties for commercial purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No personal data is communicated to third parties without the prior consent of the data subject, except in the cases provided for below.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NOVALLIANCE LIMITED may communicate certain personal data to sub-processors acting on its behalf, in particular for hosting, security, technical processing, sending of communications, or payment management services, strictly to the extent necessary for the performance of the services entrusted to them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These sub-processors only have access to the data strictly necessary for the performance of their missions and are subject to contractual obligations of confidentiality, security, and data protection in accordance with applicable requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, NOVALLIANCE LIMITED may disclose certain personal data in the event of an express, legitimate, and well-founded request from a competent administrative or judicial authority, or in order to comply with an applicable legal or regulatory obligation. In this context, only the data strictly necessary is disclosed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When NOVALLIANCE LIMITED acts as a Processor on behalf of the Client, any disclosure of data to third parties is carried out only on the Client&#8217;s instructions or in compliance with an applicable legal obligation.<\/p>\n\n\n\n<h2 id=\"h-5-transfer-of-personal-data-outside-the-european-union\" class=\"wp-block-heading\">5. Transfer of Personal Data Outside the European Union<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Within the framework of the use of the NOVALYA platform, certain personal data may be hosted, accessible, or processed outside the European Union, in particular due to the location of certain technical service providers, the infrastructure used, or third-party services integrated into the operation of the Service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When such transfers are implemented and concern data relating to persons located in the European Union, NOVALLIANCE LIMITED undertakes to ensure that these transfers are carried out in compliance with the requirements applicable to the protection of personal data, in particular the General Data Protection Regulation (GDPR).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this respect, transfers of data outside the European Union are governed by appropriate legal mechanisms, including in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The implementation of the Standard Contractual Clauses adopted by the European Commission, in accordance with Article 46 of the GDPR;<\/li>\n\n\n\n<li>The use of providers located in countries benefiting from an adequacy decision recognised by the European Commission, where applicable;<\/li>\n\n\n\n<li>The implementation of additional technical and organisational safeguards aimed at ensuring a level of protection equivalent to that required within the European Union.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These mechanisms may be communicated upon simple request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client acknowledges that the use of the Service may involve the use of service providers or infrastructures located outside the European Union and accepts, in this respect, that certain data may be transferred under these conditions, subject to compliance with the guarantees provided for in this article.<\/p>\n\n\n\n<h2 id=\"h-6-retention-period-of-personal-data\" class=\"wp-block-heading\">6. Retention Period of Personal Data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Any personal data collected by NOVALLIANCE LIMITED is retained only for the duration strictly necessary for the purposes for which it was collected and processed, as well as for compliance with applicable legal and regulatory obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Procedures for deletion, erasure, or anonymisation are implemented in order to ensure that personal data is not retained beyond the duration necessary for its processing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The retention periods vary according to the nature of the data and the capacity of the data subject:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Client account data<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Retained for the entire duration of account activation. Deleted or anonymised within 24 months of account closure, save for legal obligation or evidentiary necessity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Billing, accounting &amp; contractual data<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Retained for 10 years in accordance with applicable legal obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Technical data (IP addresses, connection logs)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Retained for a maximum of 24 months, then anonymised or deleted, save for security or fraud prevention necessity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Data processed on behalf of the Client<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Retained for the duration necessary for the provision of the Service and according to the parameters defined by the Client.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client remains solely responsible for determining the retention periods applicable to the data they process through the Service, in particular when acting as Controller.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NOVALLIANCE LIMITED acts exclusively as Processor for this data and does not intervene in the definition of the purposes or retention periods, beyond making available the technical features allowing their management.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NOVALLIANCE LIMITED&#8217;s liability cannot be engaged due to the Client&#8217;s failure to comply with their obligations regarding the retention of personal data.<\/p>\n\n\n\n<h2 id=\"h-7-rights-of-the-persons-whose-personal-data-is-collected\" class=\"wp-block-heading\">7.
